DEEPAIMED PRIVACY POLICY

GENERAL INFORMATION

Certain terms contained in this Privacy Policy are defined in the License Agreement that you are required to review.

DEEPAIMED's desire is to provide a safe place for you to create a personal profile to facilitate communications and access to information in the healthcare environment, will be accessible to doctors, healthcare professionals, medical students, patients and institutions (hospitals, clinics, medical colleges). It is conceived as a free communication channel, in which contact can be established with any of its members (doctors, health professionals, patients and institutions) regardless of their location (country, city, health center). On the other hand, it allows the creation of closed workspaces, specially configured by institutions (hospitals, clinics, doctors' colleges) that wish to have a private environment. This offers the versatility of having different channels in the same device.

MEDLAB MEDIA GROUP S. L. a company that owns the DEEPAIMED application, respects the confidentiality of its customers' and users' personal information and has developed this Privacy Policy to demonstrate its commitment to the protection of privacy in accordance with European data protection legislation, Directive 2002/58/EC of the European Parliament and of the Council of 12 July 2002 and current and applicable data protection legislation and General Data Protection Regulations of 27 April 2016 (RGPD 2016/679), and its adjacent national legislation, the Organic Law on Data Protection (LO 15/99), and the Law on Information Society Services. For the purposes of this security policy, when we speak of a user, we explicitly refer to the subject that appears as the contracting party in the service agreement (both natural and legal persons), without taking into account those persons who enter the system thanks to this subscription. That is to say, if a company contracts the service of MEDLAB MEDIA GROUP S. L., this will be the only one legitimized in the exercise of rights, and not its workers, or registered physical subjects.

This company uses external services, providers and payment platforms of third parties to be able to make their services effective. As long as Medlab Media Group complies with the security requirements demanded by the different policies and regulations in force, the responsibility for any damage or incident related to third parties, or on an external platform to Medlab Media Group tools, is beyond the responsibility of Medlab Media Group for all purposes. With the acceptance of this privacy policy, it is understood that the responsibility for any incident in these parameters described is the responsibility of third parties, against whom the user must take the measures it deems appropriate.

USE AND DISCLOSURE

You must bear in mind that when you register as a DEEPAIMED user you give your express and unequivocal consent for the information you provide to be processed by DEEPAIMED for the specified purposes detailed in this Privacy Policy. This will be evident both in the initial acceptance of the system and in the registration of individual users.

When you access the application or use any of the services, you expressly authorize DEEPAIMED to collect and use your personal information as described in this Privacy Policy. Your data is transferred to three platforms to analyze user behavior, in addition to analyzing application functionality.

REQUEST FOR INFORMATION

This Privacy Policy applies to all customers or users of the Application, describes the terms in which information is processed by DEEPAIMED and sets out our policies and procedures regarding the collection, use and disclosure of personal information you provide in connection with your access to our Application, use of the Services and your data protection rights as a data subject.

This policy applies each time you access the application or use the services, and regardless of the geographic location of such access or use.

INFORMATION OF DATA PROCESSING

-Responsibility for data processing

In accordance with the aforementioned European and Spanish data protection legislation, DEEPAIMED treats the personal data that you have provided and the data collected by our services that are regulated in the DEEPAIMED Application License Agreement.

MEDLAB MEDIA GROUP S. L. MEDLAB MEDIA GROUP S. L., informs users of its Application that personal data collected by the company will be entered into a processing system under the responsibility of MEDLAB MEDIA GROUP S. L. with the purposes set out in later sections. MEDLAB MEDIA GROUP S. L. is located at CALLE GENERAL CASTAÑOS, 1.º IZQ, 28004, MADRID, SPAIN. Consequently, the applicable jurisdiction and regulations are Spanish.

As long as the user does not communicate otherwise MEDLAB MEDIA GROUP S. L. will understand that their data have not been modified, that the user undertakes to notify MEDLAB MEDIA GROUP S. L.. any variation thereof and that MEDLAB MEDIA GROUP S. L. If you do not agree to their use, you consent to their use under the conditions set out in the following points.

In addition, MEDLAB MEDIA GROUP S. L. DEEPAIMED, informs users that it will be responsible for the data entered in the DEEPAIMED forms and must take the necessary technical and organisational measures, according to the level of security of the data collected and the special nature of the data, to ensure security in order to prevent their alteration, loss, sending or unauthorised access, destruction, marketing, registration or any other unlawful processing.

In the case of non-professional users, you can expand your profile by entering more optional and voluntary data. This means that information given voluntarily, freely, publicly and at the proposal of the user, will be considered for regulatory purposes, public information.

On the other hand, if you do not provide all the basic data necessary for the configuration of your profile, it may not be possible to use certain features of our services because such information may be required to register as a user or to use specific features, as well as if you do not accept both the privacy policy and the conditions of service.

-Information on data processing

MEDLAB MEDIA GROUP S. L. will process the following data that you provide when you create a user account:

  • Identifying information (e.g., name, user name, address, zip code, telephone number, mobile phone number, e-mail address, identification document, organization you work for and position in).
  • Profile information (e.g., age, gender, country of residence, language preference, areas of legal expertise and any information you decide to put in your Medlab Media Group S. L. user profile)
  • Medical ID
  • Electronically identifiable information (e.g., IP addresses, cookies).
  • Quality of search and survey results.
  • Information about your interaction and use of Medlab Media Group S. L. Services, our products and websites, including connection, platform, device and equipment information; information about customer performance, error reports, device capacity; bandwidth; statistics on page views; traffic to and from our websites; usage statistics.
  • Products or services contracted
  • Correspondence between Medlab Media Group S. L. and you.
  • Information on the searches carried out and the documents accessed. Information about your interactions with documents (e.g. bookmark, print, add notes, select fragments).
  • Number of users in your Organization
  • Whenever necessary, due to service needs, or process typology, it is also possible for the system to ask for basic patient information: age, weight, height, pathology, diagnosis, symptoms, treatment, results.
-Period of time of treatment

The personal data provided will be kept for as long as the contractual relationship between MedLab Media Group and the companies, organisations, doctors, specialists, professionals, students and other contracting parties is maintained, and for the first six months after the termination of the service, unless the user exercises his/her right of cancellation and forgetting, from the registration platform and complying with legal requirements.

-Information on the purposes of data processing

MEDLAB MEDIA GROUP S. L. will treat your data according to the following purposes:

  • Manage your user account and support you as a customer.
  • Specify the search to the typology of the user
  • Manage your rights contained in this Privacy Policy and in our License Agreement.
  • Improve our products and services and manage our business.
  • To carry out research analysis on the use made of our Service and its Contents.
  • Communicate with you by e-mail, postal mail, telephone, text messages or notifications in order to send you relevant information, promotions or advertising of our Services and promotions or advertising from third parties that we believe may be interest to you.
  • Allow Content that you voluntarily post to be visible to other users of the Service, with no privacy restrictions.
  • Transfer your data to authorities and courts in connection with an investigation or proceeding, court order or request for cooperation in an enforcement of existing legislation.

Give your data to third parties to protect and defend the rights or safety of our company our users, our employees or others or in the event of illegal activity.

Allow access to their data to providers contracted to provide services on behalf of DEEPAIMED to the extent strictly required by the access to the data.

Profiling is any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects of a natural person, in particular to analyse or predict aspects relating to the professional performance, financial situation, health, personal preferences or interests, reliability or the behaviour, location or movements of that natural person.

It is important to stress that every data subject has the right not to be the subject of a decision based solely on automated processing, including profiling, which produces legal effects on him or significantly affects him in a similar way.

CONSERVATION OF YOUR PERSONAL INFORMATION BY MEDLAB MEDIA GROUP S. L.

DEEPAIMED will retain your personal information to the extent and under the terms necessary to provide our Services and, in general, to use them for the purposes described in this Privacy Policy.

Your personal data will be blocked and stored internally and, therefore, will no longer be visible to other users at the time you have unsubscribed from your user account canceling it, until 6 months after unsubscription. After your cancellation, DEEPAIMED may only use your data to comply with legal obligations before authorities and courts when a law so provides, with the aim of resolving disputes between users or in the event of knowing the existence of an illegal activity of a user.

SECURITY OF YOUR PERSONAL INFORMATION

DEEPAIMED has implemented appropriate security measures to protect your information in accordance with the requirements of current European and Spanish data protection legislation and industry standards, in order to protect your personal data from unauthorized access, disclosure to third parties or possible destruction.

Within these, physical and logical security measures have been stipulated in accordance with the provisions of ISO 27001 and European Regulation 2016/679, in such a way that computer threats are largely prevented.

DATA PROTECTION RIGHTS

In accordance with current and applicable legislation on data protection, both users and final recipients of the service provided by Medlab Media Group have the right to exercise the rights of access, rectification, limitation of processing, deletion, portability and opposition to the processing of their personal data, as well as the revocation of consent given for the processing of them.

You also have the right to unsubscribe from your account as described in our User License Agreement. In this case, DEEPAIMED will cancel your personal information within 48 hours. Your data will be kept and properly blocked in the terms set out in section 5 of this Privacy Policy.

As soon as you have cancelled your data due to the cancellation of your account, you will not be identified as a DEEPAIMED user.

Specifically, the rights that users may exercise during the processing of their personal data are the following, by virtue of Article 15 et seq. Regulation 2016/679:

  • Access: the data subject shall have the right to obtain confirmation from the controller as to whether or not personal data concerning him or her are being processed and, if so, the nature of such data.
  • Rectification: the data subject shall have the right to obtain without undue delay from the controller the rectification of inaccurate personal data concerning him/her. Taking into account the purposes of the processing, the data subject shall have the right to have incomplete personal data supplemented, including by means of an additional declaration.
  • Deletion: the data subject shall have the right to obtain without undue delay from the controller the deletion of personal data concerning him/her, who shall be obliged to delete personal data without undue delay when any of the circumstances set out in Article 17 of Regulation 2016/679 occur.
  • The data subject shall have the right to obtain from the controller the limitation of the processing to that established in this policy.
  • The data subject shall have the right to receive the personal data concerning him or her which he or she has provided to a controller in a structured, commonly used and machine-readable format and to transmit them to another controller without being prevented by the controller to whom they have been provided.
  • Every data subject shall have the right not to be the subject of a decision based solely on automated processing, including profiling, which produces legal effects on him or significantly affects him in a similar way, unless otherwise provided for in Article 22 of that Regulation.

In certain circumstances and on grounds relating to their particular situation, data subjects may object to the processing of their data. In this case, MedLab Media Group will cease processing the data, except for compelling legitimate reasons, or the exercise or defense of possible claims.

You may exercise your rights by writing to Medlab Media Group S. L., Calle Pollensa n. 6, EDF. ECU 2, 2.ª Planta, 28290, Las Rozas, Madrid, enclosing a copy of your identity document and indicating the action requested, or by sending an e-mail to d.romano@medlabmg.com.

In the event that DEEPAIMED has provided your personal information to third parties, in accordance with the provisions of this Privacy Policy, the processing of your personal data will subject to the policies of those third parties, in accordance with current legislation. For the correct sending of information, Medlab Media Group S.L. will ensure the security measures provided by the third company, and the means of transmission of information.

CHANGES TO THIS PRIVACY POLICY

DEEPAIMED may occasionally update this Privacy Policy. You will always be informed promptly when we make significant changes to it. We recommend that you occasionally report any updates or changes to this Privacy Policy.
